Terms of Service

Please read the information below thoroughly and carefully before deciding whether or not to commission me. If you do not agree to any of the stated terms then I may not be the artist for you.

General

You are paying for the high-resolution digital file in PNG format.
The file will be sent to you as a google drive link through your choice of social media/ private messaging, whereupon you can download the piece.
Not all artwork I produce is uploaded to my social media accounts
If you specifically do not want the piece uploaded, or want it uploaded on a particular day, please let me know before I start.
All works contain a small logo watermark somewhere on the piece as an identifier. This is NON-OPTIONAL and must not be removed from the image under any condition.
I reserve the rights to refuse any commission I do not feel comfortable doing.
I also reserve the rights to cancel your commission at any time.

In the event that this happens, you will be issued a full refund if the piece has not been started or a 50% refund if the piece has entered the base color stage.
The colors of your final piece may differ slightly from your character’s palette in order to match my style.
I reserve the rights to experiment with my style as I do your commission.

As a developing/ beginner artist, my style is constantly adapting with each piece I draw.
Progress updates are not always a given but can be requested.

In the event you would like progress updates, I am willing to send watermarked low-quality PNGs at each progress milestone.
Canvas size may differ slightly per piece but is always 350dpi unless requested otherwise.
If you are not specific about what you want, the piece will be fairly simple unless your character inspires me to try something in terms of composition.
If you leave things up to my interpretation and the character inspires me, I may not charge you for interacting/ held objects.
If you wish to receive the PSD file in full for study purposes, this is an additional fee of $3 for the un-merged file.
If you wish to receive the PSD file for purposes relating to commercial matters, this is:

-an additional $5 for the layer sections merged for editing

-an additional $8 for the layers un-merged.

As the artist

I reserve the rights, as the creator of the art, to use it in any way I please.

Please note, this does not include merchandising.
I will always quote you as the owner of the character when uploading/ re-uploading the piece.
I may use your piece to promote my art on my various social media accounts.

I reserve the rights to remove your copyright privileges and/or ownership of any of my art pieces in the following circumstances:

The art was received without pay and I no longer wish to be associated with a brand, company, individual or character.
The art was a commission and I no longer wish to be associated with a brand, company, individual or character.

In this case, you will be refunded unless the next point is found to be true.
I have found that you are using my art for commercial purposes without permission or paying a commercial fee.

You will be given 14 days to pay at least 20% of the commercial fee if this is found or I have the rights to take back what I created.

As the commissioner

You may upload the art onto any of your social media accounts for non-commercial purpose.
You may also print the art for personal usage (whether that be posters or charms etc.) but may not make a profit from these
You may add the cost of any commission to the overall value of your character in the event you decide to re-sell them.

Work Speed

Due to various illnesses and having a full-time job, my work speed varies from a few hours to a few months.
If the piece has not been started within 3 months I will issue a full refund if payment has been given.
I reserve the rights to clear my to-do-list at any time
In the event that the list is cleared, any paid commissions will be fully refunded.
I will do my best to keep you updated via social media of any change in circumstances
If you want the piece completed for a particular day, please let me know when asking for a commission and I will let you know if that is possible.~

This may incur a rush fee of up to 30% of the overall price.
On days that I am ill or lacking inspiration, I may draw other things. This does not mean that I have forgotten or don’t plan on doing your commission.
However, if you have paid in full, it is highly unlikely that I will do any other piece of art.
If you have asked for progress updates, I retain the right to start/ complete other pieces of art while I wait for your response.

Changes

If you do not trust my judgment, please request updates.
Minor changes can be made at any stage of the commission

These can be adding small accessories and other things that will not require un-merging the entire layering process
Major changes, such as outfit changes, hairstyle, pose or held/ interactive objects cannot be made after the sketching stage.
if you require a change, I may add:

- an extra 50% of the cost for restarting from completing the lineart stage

- a 100% extra cost for completely restarting the drawing

- a 25% extra cost of the change required is of a medium difficulty changing from the lineart stage (e.g. leg position/ arm position.)

Payments

I will request payment before starting the commission.
You may choose whether you want to pay the full price upfront or half now/ half later.
You will NOT be given the un-watermarked, high-quality piece until you have paid in full.
I reserve the rights to add an extra charge for complex characters, additional objects, weaponry, armour or features that will take me extra time to complete or require additional study to add.
Payment will be requested via an invoice over PayPal or over Ko-Fi where the amount reaches a multiple of 3.

Refunds

If your piece has not been started you will be given a full refund.
If your piece has not been started within 3 months I will give you the option to take a refund or wait longer.
In the case that you are waiting for a further 2 months, a full refund will be automatically issued.
If the lineart is complete by the time you request a refund, you will be given 50% of your price back.
If you only paid for half of your commission upon asking for a refund at the lineart stage, you will not be given a refund.
If you choose to charge-back at any point without consulting me (in the case your commission is incomplete) I will add you to a public blacklist that is accessible from any of my social media platforms and ban you from commissioning me again.
In the case of coloured sketch style (where the sketch is the lineart), you will only receive a 50% refund of your price.

Commercial Use

Non-commercial use is for items you will be using on personal accounts such as DA, Facebook, Twitter and other social media/ sites, usually with credit/acknowledgement that the work was not created by you.
Commercial use comes under 2 separate categories: Advertising and Products:

2x the price of the piece if you wish to use the art to advertise yourself, your business or a product. Any form of use that means the art draws attention to your site. Credit is appreciated.
3x the price of the piece if you wish to use the art to make and distribute products for profit. Credit is appreciated

Adopts and Designs

As the buyer of an adoptable/ design by me, you are entitled to use the character for any purpose you see fit as long as due credit for the creation is given at least once.
You may proceed to make merchandise or other profitable pursuits with the design, as long as you do not profit from the original artwork without paying a commercial fee.
Adopts can be re-sold at their purchased value PLUS the value of any art you paid for.
By buying an adoptable from me, you agree that you will not add additional value for art you have been gifted, traded or earned through online currencies that cannot be used in the real world.
All adopts purchased from me, no matter the price, come with commercial rights for the design only.

Full suits of armor
Extreme Gore
Hentai
Any character designed by people/ species I wish not to associate with

Gumroad Terms and Conditions

By purchasing ANY pack from my Gumroad you are agreeing to the following conditions

You will not claim the item as your own
You will give credit at least once for the adopt base
You will not re-upload the files anywhere else
You will use PSD and PNG Files for study purposes ONLY
You will not trace, copy, edit or redistribute any PNG / PSD Files

Breaking any of these terms WILL result in you being banned from purchasing further content and a place on my PUBLIC blacklist.
